GSM INTERNATIONAL based in ATLANTA, GA, USA can assist you with navigating the everchanging U.S. reciprocal tariffs requires identifying specific Harmonized Tariff Schedule (HTS) codes, determining the country of origin, and calculating potential "tariff stacking" on goods, particularly for items with significant non-U.S. content. Key strategies include monitoring for exemptions, utilizing "tariff engineering" (modifying products to fit lower-duty categories), and confirming if goods were in transit before the effective date.

Key Aspects of U.S. Reciprocal Tariffs (2025-2026)

  • Definition & Application: Under the International Emergency Economic Powers Act (IEEPA), the U.S. imposes duties on imports to match the rates foreign countries apply to U.S. goods, often targeting specific sectors like agriculture, energy, and, with potential future adjustments, manufacturing.
  • Country and Product Focus: Specific tariffs are applied to countries with high trade barriers against the U.S. (e.g., China, EU).
  • Implementation & Timing: Many reciprocal tariffs were updated and, in some cases, delayed to August 1, 2025, or later, with new rates taking effect shortly after announcement.
  • Identifying Liability:
    • Non-U.S. Content: Products containing 20% or more non-U.S. content are subject to these additional duties, while U.S.-origin content may be exempt.
    • Tariff Stacking: Reciprocal tariffs can stack with existing duties (e.g., Section 301), significantly increasing the total landed cost.
  • Mitigation Strategies:
    • Tariff Engineering: Altering product design or composition to qualify for a lower HTS classification (e.g., changing footwear to be classified as slippers).
    • Rule of Origin Review: Ensuring proper documentation for country of origin to prove non-applicability.
    • Goods in Transit: Goods already on a vessel before the effective date may be exempted.

Actionable Steps for Businesses

  1. Conduct a Customs Audit: Analyze your supply chain to identify if goods are covered by the April 2, 2025 executive order..
  2. Verify HTS Codes: Confirm the classification of goods and check if they are subject to new, adjusted duty rates
  3. Review Material Sourcing: Calculate the percentage of U.S.-origin content to determine if the product qualifies for partial exemption.
  4. Engage GSM INTERNATIONAL: Consult with us to navigate potential, complex, and changing regulations.
